Thank you for posting this WatchCroton! Does anyone know if the taxpayers have any recourse against Pat Moran, Thomas Simone, Holly Crosbie-Foote, Robert Armanini and RMA Enterprises(Feed the Birds)? This bunch and their few supporters attempted to circumvent the results of three different elections, multiple approvals by multiple review boards, and the State Environment Quality Review claiming the court system is the only place they could get a fair judgement. For the judge to find their arguments were not supported by facts and disagreement does not provide the right of these petitioners to accuse the Board of being arbitrary and capricious in their decision making process after all the vitriol spewed to the contrary is appalling and should not go unpunished.

I couldn’t agree with you more …. However, to take them to court so they would be required to pay Croton taxpayers the close to $500,000 dollars would cost us all more money. And notwithstanding that fact …. taxpayers need to have some way to challenge an irresponsible, arbitrary and capricious ruling by a government agent. This zoning change was none of those. It was developed over four years and the lawsuit was phony from the beginning. And don’t believe for one minute that politics didn’t play a huge part in it. The action might better have read “Croton Republicans vs. Croton Democratics. It was a seedy and clear attempt to portray and trumped up charge against our elected officials as well as Harmon property owners. Disgraceful is right!
