PRESENTATIONS/OTHER:  The Village Board of Trustees to review the 44 policies of the Local Waterfront Revitalization Program to determine consistency with its policy standards and conditions regarding the proposed renewal of Special Permit for Retail Use and modification of the permit for the prosed expansion for Shoprite Supermarkets Inc. at 460 S. Riverside Avenue.  The Board must make a finding of consistency with the LWRP in order for the application to move forward.  The Planning Board has recommended favorably and the Waterfront Advisory Committee has found the proposal to be consistent. The Village Board is the Lead Agency on this application.


PUBLIC HEARING:  To consider Local Law Introductory No. 3 of 2016 to repeal the prior tax cap override Local Law 1 of 2016 and reinstates the tax levy limits imposed by General Municipal Law Section3-c.    As the Village Board is not anticipating the need for an override of the tax cap levy limit based on its current tentative budget for 2016/2017, it is necessary to repeal the prior override law in order ensure residents are eligible for a Tax Freeze rebate check.


  1. JoAnn Fannon, Carol Shanesy, Rosalind Morrissey, Organizers for the Community Blood Program; re: Outreach for the blood drive on Sunday, May 1 at the Croton-Harmon High School from 9:00 Am to 3:00 PMThe letter asks the Board to promote the blood drive on May 1 and encourage participation by all eligible donors for this event.
  2. Phyllis Bock, Director of Education, Teatown Lake Reservation; re: Permission to use Silver Lake Park for the Trout Release Program.  Teatown is requesting permission to use the park on three dates for about  2 hours each to release trout.  The board has granted this request for several years.  Ms. Bock also tanks the Village for its support of the Eaglefest event at which they estimate attendance of over 4000 this year.


  1. The Village Board of Trustees schedules a Public Hearing on the 2016-2017 Tentative Budget forMonday, April 11, 2016 at 7:30 pm in the Meeting Room of the Stanley H. Kellerhouse Municipal Building.  Prior to adoption of a budget, the Village must hold a public hearing on the tentative or proposed budget.
  2. Authorizing the Board of Trustees to sign the 2015 sponsor Approval for Volunteer Fire Department Service Award Program.  The Volunteer Service Award program for Croton’s volunteer fire Department was begun in 2003 and requires annual reauthorization by the Board.
  3. The Village Board of Trustees finds that the property located at 34 Sunset drive is in violation of Village Code Section 179, Chapter 1, and must be abated to protect the health, safety and welfare of the Village residents, and that the total costs of the abatement will be added to the Village tax bill.   A Notice of Violation and Order to Remedy has not been complied with.  The costs of this abatement will be added to the property tax bill for that location.
  4. The Village Board of Trustees authorizes the Village Manager to join the H-GAC cooperative purchasing program. This is a purchasing program for fire department equipment which is intended to secure competitive pricing.
  5. The Village Board of Trustees authorizes the Village Manager to sign the amended Service Agreement between ProClaim, Inc. and Croton EMS for medical billing services.  ProClaim has been providing billing services for Croton EMS since 2008.  This contract would reduce the percentage fee from 8% to 7 ½% of monies collected by ProClaim on behalf of Croton EMS.
  6. The Village Board determines that Local Law Introductory 4 of 2016 amending the Zoning Code for 120 Scenic Dr. West to bean unlisted action, declares itself Lead Agent for NYSSEQRA purposes, issues the EAF and CAF, refers the Draft Law to the Village Planning Board for a report, refers the Draft Law, EAF and CAF to the Waterfront Advisory Committee and Westchester County Board/Planning Department for review and recommendation. This begins the process for a prosed rezoning of this property fro its current O-2 Limited Office to RA-25 Residential.  It is the current location of the Hendry Building.
  7. The Village Board of Trustees authorizes a reparation payment to Mark Franzoso in the amount of $5,440 for damage to a lateral sewer line, and authorizes the Village Treasurer to transfer $4,000 from the Contingent account.  In 2003 the Village undertook sidewalk repair work and contracted the work to Accocella Contracting.  During this work a lateral sewer line was damaged.  The contractor made a repair but in 2013, a scoping camera determined that the repair was not done correctly.  In the interim, Mr. Franzoso experienced sewer backups which he paid for.  He submitted a claim in 2013 which was denied by both the Village’s insurance carrier and the contractor’s insurance carrier due to passing of the statute of limitations.  The resolution calls for payment based on the damage not being discovered until the stature of limitations had passed but with no admission of liability.
  8. The Village Board authorizes the issuance of a special permit to the Blue store to sell ice cream at Vassallo Park during Earth Day on April 30, 2016.  Special permits are required for vendors to sell food in Village parks.
  9. Authorizing the Village Manager to sign the amended Operating Plan with the Down to Earth Farmers Market for the 2016 season, which will change the location to Section/Parking Lot A of the Croton-Harmon Train Station.  The market had previously operated at the intersection of N. Riverside and Municipal Place.  The hours will remain the same from 9 am to 2 pm at the new site.

    Wow! Supporting Croton United is the best investment in town! Make a donation and less than 6 months later you quintuple your investment. Schmidt gives Franzoso over $5,000 of taxpayer money for an alleged broken pipe 13 years ago?!?! Unbelievable!
